Waqf Amendment Bill 2024: Implications for Hindus and the Battle to Protect Indian Heritage

Question for the reader – did you know who is the 3rd largest land owner in Bharat ? Am sure many of us didnt know the answer to that nor did we care to find out. Chances are that we “assumed” it was temples because “supposedly” Bharat’s population is Hindu (70% or 80%… again no one knows) and temple land ownership have always been extensive.

If you are a Hindu, find a dark corner to cry your heart out because after Government of Bharat, the two largest land owners in Bharat are the Catholic Church at number 2 and the Waqf board at number 3. “Supposedly” Christians constitute 2.5 to 4 % and Muslims constitute 14% of Bharat’s population. How the hell did the Catholic Church and the Waqf board grab so much land ??? Continue sleeping and soon the Government of Bharat will be a minority land owner 🤬.

Consider the following statements and hopefully they raise a few questions and you go looking for answers….

India is “supposedly” a secular country with minorities having the first right to all resources as stated by a former PM. The second largest religious population at 14.2% (official figures) of the total population still claims to be a minority. Muslim personal law board is above the Constitution of India. Temple land, donations etc are controlled by the Government of India while the Churches and Mosques are not because we are “secular”.

If you are a Hindu, are you riled up ? If not I have more statements and questions …. but the important thing is where does it leave the Hindus ? The only religion in the world that is truly secular by nature and doesn’t ask anyone to convert to its way is facing its biggest battle today. The only way of life that can ensure that the Earth survives for several more millennia is being threatened from every side.

This invasion is very different from the earlier invasions … those were barbarians, out to loot and plunder a rich nation. This invasion is insidious, it wants to end our civilisation, our culture and most importantly our way of life. If you are a Hindu woman, cry more because every vote to CONgress and its allies, every time you marry outside your faith, you are adding an accelerant to the Hindu civilisational pyre. The fire is tall and burning fast…. if you can’t see them, well, you shall be consumed by the flames.

Recently, the nation was jolted by the startling revelation that a completely Hindu village in Tiruchendurai, Tamil Nadu, which houses a Hindu temple over 1500 years old, has been designated as Waqf property. This has left Hindus baffled, as they wonder how a religion that arrived in this region in the 10th century can claim ownership of land and a temple that existed long before its arrival. The Waqf Act is the root cause of this injustice.

I would want want to highlight the oppressive aspects of the Waqf Act:

1. Waqf refers to a property donation made by a believer to be managed by a trust for religious or charitable purposes. According to the true definition of Waqf, the property is dedicated to serving Allah, and thus, its use is governed by Islamic law.

2. Additionally, the Waqf Act requires the Government to conduct a survey of all Waqf properties every 10 years. But who funds this survey? The taxpayer! Why should the taxpayers, who primarily belong to the majority community, bear this cost?

3. The Waqf Act includes a harsh provision that allows the Waqf board to seize any property without notifying the person who owns or resides on the land, as was the case in Tiruchendurai. The only recourse for the affected person is to appeal to the Waqf tribunal.

4. The Waqf tribunal, under section 83 of the act, is governed by Sharia law. How can it be just that a non-Muslim is compelled to seek justice from a tribunal operating under Islamic law?

5. Section 85 is even more troubling. Civil courts have no authority over such disputes! It is crucial to note that no other minority group (Sikhs, Jains, Parsis, etc.) has been granted such sweeping powers.

6. The Waqf Act is exempt from the statute of limitations, which contradicts the Limitation Act of 1963. This means that a Waqf Board can, at any time, lay claim to any property.

7. Lastly, the Act grants the Waqf board unchecked power to claim any property. As a result, Waqf properties are estimated to encompass approximately 6 lakh acres across the nation, making the Waqf board the third-largest landowner in India! This represents a covert appropriation of the country’s resources, all under the protection of our own laws.

The Hon’ble Prime Minister, Shri Narendra Modi, recently remarked that we must rid ourselves of the colonial mindset. This mindset is not solely a British legacy; as long as this Mughal-era law remains, we cannot fully shed this colonial mentality. This is evident from the following two examples:

1. Former Prime Minister Manmohan Singh once stated that minorities (specifically Muslims) have the first claim on India’s resources.

2. The Indian National Congress took this statement to heart and transferred 123 prime properties in Delhi to the Waqf board.

This is a direct affront to the secular values of our nation!

Indians believe in equality before the law for all citizens. However, what remains hidden is that some are more equal than others, as is clearly demonstrated by the provisions and application of the Waqf Act.

Hence, following the constitutional principles of equality and justice, I demand that:

1. The Waqf Act be immediately amended or repealed.

2. All properties currently held by Waqf Boards across the country be taken over by the Government. Following this,

3. High-level committees should be established at both the national and state levels to investigate each of these properties so that they can be returned to their rightful owners.

4. We have had a personal experience where one of our properties had to be checked for Waqf free ownership as the area had a lot of Muslim population. Thankfully it was Waqf free. This house was built by my father through hard work and his own earnings. That’s how dangerous this law is. 

5. Sincerely want Bharat to have one law governing all its citizens. One Country One Law.

Those Hindus who still feel pained by this Waqf amendment bill and the fact that some Hindus are making a concerted effort to bring in the amendments, feel free to join the efforts made by the All India Muslim Personal Law Board to ensure the draconian law remains as it is… and watch as the temples are razed to the ground and your house is suddenly deemed a Waqf property – “forever”.

  1. Bindu, We have comunicated for years, but always in English. I’m learning how difficult it is to understand another’s culture, traditions, and language without a comprehension of that, too. Of course I agree with you, as usual, but I don’t understand how profound these transgressions of law are to those with heritage attached to their cultural history.
    For instance, what is the language most often spoken in the Indian Parliament? English has become the so-called Universal Language, I suppose, but what language is used when Hindus converse among themselves?

    • Katharine, we have 27 official languages and thousands of dialects. Hindus speak one or more of these 27 languages. Hindi and English are the languages most used in the Indian Parliament, but many members also speak in their mother tongue which could be Bengali, Tamil, Telugu, Marathi etc. This blog is about how the Church and the Waqf (Islamic body) board have managed to become the 2nd and 3rd largest land owners in India. It’s a threat to the Hindu culture and civilisation because most of this land belongs to the Hindu Temples. Through invasions (Mughals etc) and colonialization (British) the temple lands have been misappropriated. 🙁 If left unchecked, Hindus will soon lose their identity and cultural heritage because both are closely associated with the temples. This is a silent invasion, all the more worrying.

      Particularly the Waqf board has laws that are not part of the constitution of India. They can simply grab any land and term it as a Waqf property in perpetuity. The earlier governments made these changes to appease the Muslim voters but it has now become a bigger issue. The Modi Government is trying to bring amendments to the Waqf bill and soliciting suggestions from everyone. Hindus in general behave like ostriches with our head inside the ground and we assume that Hinduism will survive any which way… sadly our population is whittling down, our population growth rates are decreasing while the Muslim population is growing at alarming rates. Nothing against any religion, but the Muslim population has to follow the law of the land, but they would prefer the “Sharia law”. Don’t think Hindus have a place in that scenario.

      The implications are quite grim if things were to continue down the same path as before … appeasement of minorities etc. Hence trying to make a small stand.

      • Bindu, Thank you for your concise summary of India’s political and ethno-religious situation. It’s rainy today, and I have been indoors, with screen door open and my rooster Speckles on the brick porch, where we can see each other.
        Because I can’t move from this spot, I have been reading online about Will Durant, the historian and philosopher who wrote about Western civilization. He also wrote, with his wife, about India, commenting that the period of British rule bled India, such that he was shocked by the poverty on the streets. This was around 1935. Durant died in 1981, at age 96, in a medical center in California, only a couple of days after he heard on the news that his wife had preceded him.
        His book, The Story of Philosophy, was required reading in one of my college courses. I pulled it off my shelves the other day and wanted to read what he wrote about Socrates, who died in 399 BC. This was a state-ordered punishment by the “democracy” of Athens for “corrupting youth”, among other things. Plato was inspired by Socrates and summarized Socrates’ world view in a series of conversations that summarized his philosophy. Then, Aristotle, who was Plato’s student, was invited to the court of Philip, King of Macedonia, to tutor his son, who became Alexander the Great. You probably know that Alexander traveled with his army eastward as far as India. He died at age 32 in Babylon, leaving many settlements named for him along his path. Alexandria in Egypt, for instance.

        To your point about Hindus’ political disenfranchisement in India, I can only say that you are doing what you can to save a weakened tradition and way of life. Also, PM Modi is doing what he can, and I admire his efforts to defend India’s ancient customs, tradition, and temples. He is a good spokesperson for India, capable of finding diplomatic paths between challenging adversaries.
        We all have roles to play in this chaotic present.

  2. WAQF board should be stripped of the unfair privileges granted to make them on par with other property owners. Secularism does not mean giving unfair advantage to any one community.
